Definitions:
• Eva Wagensveld: Eva Wagensveld, established in Amsterdam under Chamber of Commerce number 80081037
• customer: the person with whom Eva Wagensveld has entered into an agreement
General
These conditions apply to every offer, treatment and transaction between Eva Wagensveld and a customer to which Eva Wagensveld has declared these conditions applicable, insofar as the parties have not expressly and in writing deviated from these conditions.
Efforts
Eva Wagensveld will carry out the treatments to the best of her knowledge and ability and in accordance with the requirements of good workmanship and on the basis of the current state of science. Eva Wagensveld will, as far as can reasonably be expected, inform the client about the financial consequences of changes or additions to the agreed treatment.
Appointments
The customer must report any impediment to an appointment to Eva Wagensveld as soon as possible, but no later than 24 hours prior to the appointment. If the customer does not comply with this obligation or does not do so on time, Eva Wagensveld may temporarily charge the entire fee for the agreed treatment. This also applies if the customer arrives at the agreed location more than 10 minutes later than the agreed time. This is out of respect for the customer who comes after you.
Eva Wagensveld must report any impediment to an appointment to the customer as soon as possible, but no later than one working day prior to the appointment. Both parties do not have to comply with these obligations if they are hindered by force majeure. Force majeure because of what the law and case law says about it.
Payment
Eva Wagensveld lists all prices of treatments and products visibly on the website. The reported prices include 21% VAT. Eva Wagensveld may change all prices that Eva Wagensveld charges for its products or services, whether published on its website or otherwise, at any time. The customer must pay for the treatment via iDeal, by bank transfer or in cash immediately after the treatment.
Personal data & privacy
Before the first treatment, the customer provides Eva Wagensveld with all information that Eva Wagensveld indicates is necessary or of which the customer should reasonably understand that it is necessary for the careful execution of the treatments.
Eva Wagensveld records the client's personal data in an automated system and treats the client's confidential data in accordance with the guidelines in the Personal Data Protection Act. Eva Wagensveld will not sell or rent customer data to third parties without prior written permission from the customer.
Confidentiality
Eva Wagensveld is obliged to maintain confidentiality of all confidential information that the customer has provided during the treatment. Information is considered confidential if this has been communicated by the customer or if this arises from the nature of the information. The confidentiality lapses if, on the basis of a legal provision or a court decision, Eva Wagensveld is obliged to provide the confidential information to third parties.
Liability
Eva Wagensveld is not liable for damage of any nature whatsoever caused by temporarily relying on incorrect and/or incomplete information provided by the customer about relevant physical conditions, medication use, work or leisure activities. Eva Wagensveld is not liable for loss, theft or damage to personal belongings that the customer has brought to the studio.
Warranty
Eva Wagensveld gives the customer a one-week (7 days) warranty on the treatment and products. This warranty is void if:
• The customer does not complain within 24 hours by means of a message with a photo.
• The customer has worked with aggressive chemicals without gloves.
• The customer has 4 or more damaged nails.
• The customer has bitten off or deliberately broken off the (artificial) nails.
• The customer has used products other than those recommended by the nail studio for the maintenance of the (artificial) nails.
• The customer has not followed the advice for home care of the (artificial) nails.
• The customer has not followed the advice to seek medical help within five working days.
Damage and theft
Eva Wagensveld has the right to demand compensation from the customer if the customer damages furniture, equipment or products. Eva Wagensveld always reports theft to the police.
Complaints
If the customer has a complaint about the treatment or a product, this must be reported in writing to eva as soon as possible, but within two working days after discovery. Eva Wagensveld must provide the complainant with an adequate response within five working days. If a complaint is justified, Eva Wagensveld will carry out the treatment again as agreed, unless this has demonstrably become pointless for the customer and the customer makes this known in writing. If Eva Wagensveld and the complainant cannot reach an agreement, the complainant can submit the dispute to the legislator or mediator.
Nail art
If Eva Wagensveld shows an example of a nail art design to be applied, this is only an indication. The result on the customer's nails does not have to be identical to the example shown. The copyright on applied nail art motifs rests with Eva Wagensveld. If the customer has the applied nail art photographed for commercial use, permission must be requested from Eva Wagensveld in advance. Eva Wagensveld may demand a reasonable compensation for this in addition to stating the company name and surname.
When taking photos that are distributed on websites or social media, Eva Wagensveld must be mentioned to prevent misuse by third parties. Verbal permission from the customer will always be requested for the use of photos of the customer to promote Eva Wagensveld.
Decent behavior
The customer must behave properly in the studio according to generally accepted standards. If the customer continues to exhibit inappropriate behavior after repeated warnings, Eva Wagensveld has the right to refuse the customer access to the salon without stating reasons.
House rules
Eva Wagensveld applies the following house rules:
• The customer is not allowed to bring guests without prior permission.
• All treatments are only performed on persons aged 18 years and older.
Law
Dutch law applies to every agreement between Eva Wagensveld and the customer.
These conditions have been filed at the office of the Chamber of Commerce in The Hague
In case of interpretation of the content and scope of these general terms and conditions, the Dutch text always prevails.
The most recently filed version or the version that applied at the time the agreement was concluded always applies.
